Terms of Service

Effective

These Terms of Service (“Terms”) are an agreement between you and Financial Valet (“we,” “us” or “our”). They apply to your use of yourfinancialvalet.com (the “Site”), including the price tool, the contact form and call booking. Please read them carefully.

By using the Site, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Site.

1. Using the Site

You must be at least 18 years old and able to enter into a binding contract to use the Site. If you use the Site for a business, you confirm that you are authorized to accept these Terms for that business, and “you” includes the business.

2. Our services are agreed in writing

The Site describes our bookkeeping and outsourced accounting services. Using the Site, getting a price, sending us a message or booking a call does not make you a client and does not create a professional or advisory relationship between us.

We provide services only under a separate written agreement, such as an engagement letter or service agreement, that sets out the scope of work, fees and each party’s responsibilities. If that agreement and these Terms conflict, the agreement controls. We may decline to take on any engagement.

Unless your engagement agreement says otherwise, our services do not include preparing tax returns, giving legal advice, or performing audits, reviews, compilations or other attest services.

3. Prices and estimates

  • Prices on the Site are in U.S. dollars, per month, and are estimates based on the answers you give. They are not an offer or a binding quote.
  • Your actual price is set in your engagement agreement. It may differ from the estimate if your needs differ from your answers, for example if your books need catch-up work or you have more accounts or transactions than expected.
  • A price shown as “starts at” is the lowest price for that service. Your price depends on what you need.
  • Prices don’t include taxes, if any apply.
  • We may change the prices on the Site at any time. A change doesn’t affect an agreement you’ve already signed, except as that agreement allows.
  • If a price on the Site is wrong because of an error, we may correct it, and we aren’t bound by the error.

4. Buying a plan online

If you buy a plan through the Site, your payment is handled by a third-party payment processor, and its terms also apply. By buying, you authorize us and our processor to charge your payment method for the plan you choose, plus any taxes.

Monthly plans renew automatically each month until you cancel. The checkout page and your engagement agreement explain billing dates, how to cancel and any refund terms. We provide the services you buy under a written engagement agreement, as described above.

5. Booking a call

You can book a call with us through the Site. Times are shown in Eastern Time. Booking a call doesn’t commit you to buying anything. You can change your time from the confirmation on the Site or by contacting us. If we need to reschedule or cancel, we’ll try to let you know as soon as we can.

6. Information you send us

  • Please give us accurate, current information.
  • Don’t send sensitive information through the Site’s forms, such as Social Security numbers, bank account or card numbers, passwords or tax documents. If we need it, we’ll give you a secure way to share it.
  • You give us permission to use the information you send to respond to you and provide our services, as described in our Privacy Policy.
  • If you send us ideas or feedback, we may use them without owing you anything.

7. General information, not advice

Content on the Site is general information only. It is not accounting, tax, legal, financial or investment advice, and it may not fit your situation. Please don’t act on it without advice from a qualified professional who knows your circumstances.

8. Acceptable use

When you use the Site, you agree not to:

  • break any law or violate anyone else’s rights;
  • send false, misleading, spam or harmful content, or pretend to be someone else;
  • try to get into parts of the Site or our systems you aren’t allowed to access, including the administration area;
  • interfere with, overload or disrupt the Site, or introduce viruses or other harmful code;
  • use bots, scrapers or other automated tools to access or copy the Site, except for search engines indexing public pages; or
  • copy, change, sell or reverse engineer any part of the Site, except as the law allows.

9. Our content and trademarks

The Site and its content, including text, graphics, logos, designs and software, belong to Financial Valet or our licensors and are protected by copyright, trademark and other laws. You may view and print pages for your own use in evaluating our services. You may not otherwise copy, publish or use the content without our written permission. “Financial Valet” and our logo are our trademarks.

10. Other websites and services

The Site may link to or use services run by others, such as payment processors and scheduling tools. We don’t control them and aren’t responsible for their content, policies or practices. Their own terms apply when you use them.

11. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties of any kind about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don’t promise that the Site will always be available, error-free or secure, or that its content is complete or current.

This section applies to the Site. Any promises about our services are set out in your engagement agreement.

12. Limitation of liability

To the fullest extent the law allows, Financial Valet and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to the Site or these Terms, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability for all claims arising out of or related to the Site or these Terms is limited to one hundred U.S. dollars ($100). Liability for our services is governed by your engagement agreement.

Some states don’t allow some of these limits, so they may not all apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless Financial Valet and its owners, employees and contractors from any claims, losses, damages and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms or the law.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict-of-law rules. If you have a concern, please contact us first; most issues can be resolved quickly that way. Any lawsuit about the Site or these Terms must be brought in the state or federal courts located in New Hampshire, and you and we agree to those courts’ jurisdiction.

15. Changes to the Site and these Terms

We may change, suspend or stop any part of the Site at any time. We may also update these Terms. When we do, we’ll change the effective date at the top of this page. Using the Site after an update means you accept the updated Terms.

16. Ending access

We may suspend or end your access to the Site if you violate these Terms or misuse the Site. Sections that by their nature should continue, such as “Our content and trademarks,” “Disclaimers,” “Limitation of liability,” “Indemnification” and “Governing law and disputes,” continue to apply after your access ends.

17. General terms

  • These Terms and our Privacy Policy are the entire agreement between you and us about the Site. Your engagement agreement governs our services.
  • If any part of these Terms can’t be enforced, the rest stays in effect.
  • If we don’t enforce a part of these Terms, we haven’t given up our right to enforce it later.
  • You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale of the business.
  • You agree that we may communicate with you electronically, and that electronic communications meet any requirement that they be in writing.
